Chapter 5. Use and Restriction of Game Services, etc.
Article 11 (Provision of the Service)
The Company shall enable Members who have completed a service agreement in accordance with Article 5 to use the Service immediately. However, certain services may begin on a date designated by the Company as necessary.
When providing the Service, the Company may also provide additional services together with the services prescribed in these Terms.
The Company may classify Members by grade and differentiate use by subdividing usage time, number of uses, scope of services provided, and other criteria.
Article 12 (Use and Suspension of the Service)
① The Game Service shall be provided during hours determined by the Company’s operating policy. The Company shall appropriately inform Members of service hours within the Game Service or through notices. Unless otherwise displayed or announced, the Service shall generally be available twenty-four (24) hours a day.
② Notwithstanding Paragraph 1, the Company may temporarily suspend all or part of the Service in any of the following cases. In such event, the Company shall announce the reason for and duration of the suspension in advance on the initial screen of the game Application or within the Game Service. However, if prior notice is impossible due to unavoidable circumstances, notice may be provided afterward.
- Where necessary for system operation, including regular system inspection, server expansion or replacement, or network instability
- Where normal provision of the Service is impossible due to power outages, service equipment failures, concentrated use of the Service, or maintenance or inspection of telecommunications carrier facilities
- Where circumstances beyond the Company’s control occur, including war, civil disturbance, natural disaster, or comparable national emergency
③ The Company provides the Service using Applications dedicated to Mobile Devices or networks. Members may use the Service free of charge or for a fee by downloading and installing an Application or by using a network.
④ Paid Content may be used upon payment of the fee stated for the relevant Service. When downloading an Application through a network or using the Service, separate fees may be charged by the Member’s telecommunications carrier.
⑤ Services used through downloaded and installed Applications or network services are provided according to the characteristics of the Mobile Device or telecommunications carrier. If the Mobile Device is changed, the phone number is changed, or overseas roaming is used, some or all functions of the Game Service may become unavailable, and the Company shall not be liable in such cases.
⑥ Background tasks may be performed in Services used through downloaded and installed Applications or networks. Additional charges may arise depending on the characteristics of the Mobile Device or telecommunications carrier, and the Company shall not be liable for matters relating thereto.
⑩ Notwithstanding Paragraph 1, the Service may not be provided where applicable laws, self-regulatory codes of business associations, or similar rules prohibit or restrict the provision of the Service at certain times or by certain methods, and the Company shall not be liable for matters relating thereto.
Article 13 (Change and Suspension of the Service)
① Members may use the Game Service and other services provided by the Company in accordance with these Terms, the Operating Policy, and rules established by the Company, and the Company shall have comprehensive authority over the production, modification, maintenance, and repair of the Game Service and related services.
② The Company may modify the Service as necessary for operational or technical reasons in order to provide the Game Service smoothly, and shall announce the details within the Game Service before such modification. However, the Company may give notice afterward where changes are unavoidably necessary to correct bugs or errors, to conduct emergency updates, where the change is not material, or where unavoidable circumstances exist such as server equipment failure or urgent security issues.
Article 14 (Provision and Collection of Information, etc.)
The Company shall display the following information on the Open Market page or the initial screen of the Game Service in a manner that is easy for Members to understand.
- Title of the game
- Age rating
- Rating classification number
- Date of production
- Report or registration number of the game producer or distributor
- Other matters deemed necessary by the Company
The Company may store and retain the contents of chats and other communications between Members (including messages, whispers, and similar communications within the Service), and such information shall be held only by the Company. The Company may review such information only for purposes of dispute resolution between Members, handling complaints, or maintaining order in the game, and a third party may review such information only where authorized by law.
If the Company or a third party reviews chat or other information pursuant to Paragraph 1, the Company shall notify the relevant Member in advance of the reason for and scope of the review. However, if it is necessary to review such information in connection with investigation, handling, or confirmation of prohibited conduct under Article 10, Paragraph 1, or relief for damage caused by such conduct, the Company may provide notice afterward.
The Company may collect and use Mobile Device information excluding Members’ personal information (including settings, specifications, OS version, and telecommunications carrier information) for the smooth and stable operation of the Service and improvement of service quality.
The Company may request additional information from Members for purposes such as Service improvement and introduction of services to Members. Members may accept or refuse such requests, and when the Company makes such a request it shall also inform Members that they may refuse it.
Article 15 (Affiliated Services, etc.)
An Affiliated Service is a service that may be used together with other Members who use another mobile platform, such as Kakao.
Before using the Service, Members must consent to the provision and use of personal information necessary for the Service, including their personal profile on the mobile platform. If a Member does not consent, use of the Service may be restricted.
The Company may provide multiple services through Affiliated Services. If a Member enrolled in multiple services wishes to terminate use, the Member must submit a cancellation (membership withdrawal) request for each subscribed service.
Because Affiliated Services are provided using membership information from the relevant service, normal provision of the Service may not be possible if the Member loses membership status in or withdraws from the relevant Affiliated Service.
If an installed Application is deleted, the Member’s Account Information may also be deleted; therefore, Members should confirm this before deleting the Application.
Article 16 (Provision of Advertisements)
The Company may display advertisements within the Service in connection with operation of the Service. In addition, only Members who have consented to receive them may receive advertising information by email, messaging service (LMS/SMS), push notification, or similar methods. Members may opt out at any time, and the Company shall not send advertising information after a Member opts out.
Advertisements or services provided by third parties may be accessed through banners, links, or similar features within the Service provided by the Company.
Where a Member is connected to an advertisement or service provided by a third party under Paragraph 2, the relevant area is outside the scope of the Company’s Service, and the Company does not guarantee its reliability or stability and shall not be liable for damages incurred by the Member as a result. However, this shall not apply where the Company intentionally or through gross negligence contributed to the occurrence of damage or failed to take measures to prevent such damage.
Article 17 (Ownership of Copyright, etc.)
① Copyright and other intellectual property rights in all Content produced by the Company within the Service belong to the Company.
② Members may not, without the prior consent of the Company or the relevant provider, use for commercial purposes or allow others to use information obtained through the Service in which intellectual property rights belong to the Company or the provider, through reproduction, transmission, editing, publication, performance, distribution, broadcasting, creation of derivative works, or similar means.
③ Members grant the Company permission to use communications, images, audio, and all materials and information uploaded or transmitted through the Service by the Member or other users, including conversation text related to Content within the Service (including direct content such as characters, images, and audio, as well as indirect content such as service-related information), collectively “User Content,” under the following methods and conditions.
- Use, editing, format changes, and other modifications of the User Content, including publication, reproduction, performance, transmission, distribution, broadcasting, and creation of derivative works in any form, without limitation as to period or territory
- The Company shall not sell, lease, or transfer User Content for transactional purposes without the prior consent of the user who created the User Content
④ The Company shall not use User Content that is not expressed within the Service or is unrelated to the Service (including posts on general bulletin boards that are not substantively related to in-game content) without the Member’s express consent. Members may delete such User Content at any time, and the rights and responsibilities relating to such works belong to the Member.
⑤ If the Company determines that a post or other material uploaded or registered by a Member within the Service constitutes prohibited conduct under Article 10, Paragraph 1, the Company may delete or move it or refuse registration without prior notice.
⑥ A Member whose legal interests have been infringed by information posted on a bulletin board operated by the Company may request that the Company delete the information or publish a rebuttal. In such case, the Company shall promptly take necessary measures and notify the applicant.
⑦ This Article shall remain effective while the Company operates the Service and shall continue to apply after a Member withdraws.
Article 18 (Use of Content)
Content granted through Paid Payment within the Service belongs to the Member’s Account Information and may be used on a Mobile Device logged in with the relevant account. However, for Temporary Members, such Content may only be used on the device on which the Application was downloaded or installed.
The period of use for Content provided through Paid Payment shall follow the period separately specified at the time of purchase. However, if the Service is suspended pursuant to Article 15, Paragraph 2, the period of use for Content without a specified term shall continue until the service termination date announced when the suspension is announced.
Content exchanged for other Content within the Service or consumed when using Content (the “Game Currency”) may be provided through Paid Payment or provided free of charge according to use of the Service. Game Currency provided through Paid Payment shall be used first. However, this shall not apply if a different order of use is specified within the Service.
Article 19 (Restriction of Service Use)
① Members shall not engage in conduct that violates their obligations under Article 10. If a Member engages in such conduct, the Company may restrict the Member’s use of the Service, delete related information (including text, images, and videos), and take other measures in accordance with the following. The reasons and procedures for restrictions shall be set forth in the Operating Policy of each individual game pursuant to Article 21, Paragraph 1.
- Partial restriction of authority: restriction of certain functions, such as chat for a specified period or initialization of game information
- Character use restriction: restriction of a Member’s character for a specified period or permanently
- Account use restriction: restriction of a Member’s account for a specified period or permanently
- Member use restriction: restriction of a Member’s use of the Game Service for a specified period or permanently
② If a restriction under Paragraph 1 is legitimate, the Company shall not compensate the Member for damages resulting from the restriction.
③ The Company may suspend use of the Service for the relevant account until an investigation into any of the following matters is completed.
- Where a legitimate report is received that the account has been hacked or stolen
- Where the Member is suspected of being an illegal actor, such as a user of unauthorized programs or an illicit game-farming operation
- Where payment abuse is suspected due to repeated refunds or issues involving failure to provide purchased goods
- Where temporary measures restricting Service use are otherwise necessary for reasons similar to the foregoing
④ After completion of the investigation under Paragraph 3, Content provided through Paid Payment shall be compensated by extending the use period by the duration of the suspension or by providing equivalent Content. However, this shall not apply where the Member falls under any of the circumstances listed in Paragraph 3.
Chapter 6. Withdrawal of Purchase, Cancellation and Termination
Article 20 (Payment)
Billing and payment for Content shall, in principle, follow the policies or methods established by telecommunications carriers, Open Market operators, or similar entities. Limits for each payment method may also be granted or adjusted pursuant to policies established by the Company, Open Market operators, payment companies, or government policy.
If the purchase price of Content is paid in a foreign currency, the actual amount charged may differ from the price displayed in the Service store due to exchange rates, fees, or similar factors.
Article 21 (Withdrawal of Purchase, etc.)
① A Member who has entered into an agreement with the Company for the purchase of Content may withdraw from the purchase without any separate fee or penalty within seven (7) days from the later of the purchase agreement date or the date on which the Content becomes available for use.
② A Member may not withdraw from the purchase under Paragraph 1 against the Company’s intent if any of the following applies. However, where a purchase agreement consists of separable Content, this restriction shall not apply to the remaining portion that does not fall under any of the following.
- Content that is used or applied immediately after purchase
- Content for which additional benefits were provided and such benefits have been used
- Content that has been opened where opening is deemed use or where its utility becomes fixed upon opening
③ For Content that cannot be withdrawn from under Paragraph 2, the Company shall clearly indicate that fact in a place easily recognizable by Members and shall provide trial use of the Content (such as permission to use it for a certain period or a trial version), or if such trial use is difficult, provide information about the Content so that Members’ right of withdrawal is not impeded. If the Company fails to take such measures, a Member may withdraw from the purchase even if a restriction under Paragraph 2 applies.
④ Notwithstanding Paragraphs 1 and 2, if the paid Content purchased by a Member differs from the displayed or advertised content or is performed differently from the agreement, the Member may withdraw from the purchase within three (3) months from the purchase date or date on which the Content became available, or within thirty (30) days from the date the Member knew or could have known of such fact.
⑤ When a Member withdraws from a purchase, the Company may verify the purchase history through the Open Market operator. The Company may also contact the Member using the provided information to confirm the legitimate reason for withdrawal and may request additional supporting documents.
⑥ If a withdrawal is valid under Paragraphs 1 through 4, the Company shall recover the Member’s paid Content without delay and refund the payment within three (3) business days. If the Company delays the refund, it shall pay delay interest calculated by applying the rate prescribed by the Act on Consumer Protection in Electronic Commerce and Article 21-3 of its Enforcement Decree for the period of delay.
⑦ If a minor enters into an agreement to purchase Content using a Mobile Device, the Company shall notify the minor that the minor or the minor’s legal representative may cancel the agreement if the legal representative did not consent. If the minor entered into the purchase agreement without the legal representative’s consent, the minor or legal representative may cancel the agreement with the Company. However, cancellation is not permitted if the minor purchased the Content using property that the legal representative permitted the minor to dispose of within a specified scope, or if the minor deceived the other party into believing that the minor was an adult or that the legal representative had consented.
⑧ Whether a party to a Content purchase agreement is a minor shall be determined based on the Mobile Device on which payment was made, information about the person making the payment, the name of the holder of the payment method, and similar factors. The Company may request documents proving that the person is a minor or the minor’s legal representative in order to confirm that the cancellation is legitimate.
Article 22 (Cancellation and Refund of Payments by Minors)
If a minor or other person with limited legal capacity makes a payment without the consent of a legal representative, the person or legal representative may cancel the payment. However, if the payment occurred due to the negligence of the person or legal representative, the Member shall bear the actual costs required for the refund.
Paid Payments shall follow the payment methods provided by the Open Market operator. If an overpayment or erroneous payment occurs during the payment process, the Member must request a refund from the Company or the Open Market operator. Depending on the Open Market operator’s policy or system, the Company may request the necessary refund procedure from the Open Market operator.
Telecommunications charges incurred from downloading an Application or using a network service, including call charges and data charges, may be excluded from refund eligibility.
Refunds shall be processed in accordance with the refund policy of the Open Market operator or the Company, depending on the operating system of the Mobile Device on which the Service is used.
Content obtained free of charge by a Member during use of the Service without making a Paid Payment, or Content provided free of charge by the Company through internal or external affiliated events, is not eligible for refund.
The Company may contact a Member using information provided by the Member and may request necessary information in order to process a refund.
Article 23 (Member Withdrawal)
If a Member wishes to terminate the service agreement, the Member may apply for withdrawal through a menu within the Service or through customer support. Upon completion of withdrawal, all game information of the Member (including scores, characters, items, and game currency) shall be deleted and cannot be restored. Deleting an Application or disconnecting an Affiliated Service shall not be deemed termination of the service agreement.
If a serious reason arises that makes continued maintenance of the agreement impossible, such as where a Member engages in conduct prohibited by these Terms or the Operating Policy based on these Terms, the Company may, after giving notice for a reasonable period, suspend use of the Service for a specified period or terminate the service agreement.
Refunds and damages under Paragraphs 1 and 2 shall be handled in accordance with the Guidelines for Protection of Content Users.
In order to protect the personal information of a Member who has not used the Company’s Service for one (1) consecutive year from the most recent date of use (a “Dormant Account”), the Company may terminate the service agreement and destroy the Member’s personal information. In such case, the Company shall notify the Member at least thirty (30) days before the action date that termination of the agreement, destruction of personal information, and related measures will be taken, together with the personal information to be destroyed.
Chapter 7. Damages and Disclaimers
Article 24 (Damages)
If the Company or a Member violates these Terms and causes damage to the other party, the violating party shall be liable to compensate for such damage. However, this shall not apply where there is no intent or negligence.
If the Company enters into an affiliation agreement with an individual service provider and provides an individual service to a Member, and damage occurs due to the responsibility of the individual service provider after the Member has agreed to the terms of use for the individual service, the individual service provider shall be liable for such damage.
Article 25 (Disclaimer of the Company)
The Company shall not be liable for failure to provide the Service due to natural disasters or other force majeure events.
The Company shall not be liable for damages arising from maintenance, replacement, regular inspection, construction, or similar work on Service equipment. However, this shall not apply where such damage is caused by the Company’s intent or negligence.
The Company shall not be liable for disruptions in use of the Service caused by a Member’s intent or negligence. However, this shall not apply where the Member has an unavoidable or legitimate reason.
The Company shall not be liable for the reliability, accuracy, or other qualities of information or materials posted by a Member in connection with the Service, unless caused by the Company’s intent or gross negligence.
The Company shall have no obligation to intervene in transactions or disputes arising between a Member and another Member or third party through the Service and shall not be liable for damages resulting therefrom.
The Company shall not be liable for damages incurred by a Member in connection with use of a Service provided free of charge. However, this shall not apply where caused by the Company’s intent or gross negligence.
The Company shall not be liable if a Member fails to obtain or loses expected benefits through the Service.
The Company shall not be liable for loss of a Member’s game information, including experience points, rankings, items, or game currency. However, this shall not apply where caused by the Company’s intent or negligence.
The Company shall not be liable for payments made by a third party as a result of a Member’s failure to manage password settings on a Mobile Device or password settings provided by an Open Market. However, this shall not apply where caused by the Company’s intent or negligence.
The Company shall not be liable if all or part of Content becomes unavailable due to a change of Mobile Device, change of telephone number, OS upgrade or change, overseas roaming, or change of telecommunications carrier. However, this shall not apply where caused by the Company’s intent or negligence.
The Company shall not be liable where a Member deletes Content or Account Information provided by the Company. However, this shall not apply where caused by the Company’s intent or negligence.
The Company shall not be liable for damages arising from use of the Service by a Temporary Member. However, this shall not apply where caused by the Company’s intent or negligence.
Article 26 (Notice to Members)
The Company may notify Members by email address, electronic memo, in-Service message, LMS/SMS, or similar means.
For notice to all Members, the Company may substitute the notice under Paragraph 1 by posting within the Game Service for at least seven (7) days or displaying a pop-up screen or similar notice.
Article 27 (Jurisdiction and Governing Law)
If a disagreement or dispute arises between the Company and a Member in connection with use of the Game Service or other services provided by the Company, the parties shall endeavor to resolve it amicably through mutual agreement.
If the dispute under Paragraph 1 is not amicably resolved and litigation is filed, the court having jurisdiction in accordance with the procedures prescribed by applicable laws shall have jurisdiction.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.
